The Labour Relations Act and the Code of Good Practice are very clear on what is required of business owners and managers in the retrenchment process. Since retrenchment is a "no fault" dismissal - it is essential that all possible alternatives to dismissal are explored and that the employees to be dismissed are treated fairly.

In addition to the risk of not following the correct procedures during a retrenchment process, HR professionals also need to be aware of the other negative effects that this process can cause. Very few organisations see an immediate improvement in productivity due the feelings of survivor guilt, sadness and even anger of those left behind, never mind the loss of skills because we all know that it is normally the best employees who leave first. A process that is meant to ensure the survival of a company can too often result in further loss of productivity if not managed properly.

Gary matriculated from Glenwood Boys High in 1980 and furthered his education at Natal University, completing his B.A. and LLB in 1988. After a short period doing articles in a law firm, he moved into the Human Resources / Industrial Relations profession.

 

Initially joining a FMCG group in Johannesburg as Personnel / Industrial Relations Officer, he then accepted a position as Group Industrial Relations Manager for a large hotel chain, remaining with them for a period of seven years. He is now a Director of Workinfo.com and pursues a consulting career. He founded Workinfo.com (http://www.workinfo.com) and Caselaw.co.za (http://www.caselaw.co.za) in 1996.
