National Labor Relations Board (NLRB) "Notice PostingRule" and Its Impact on Small Businesses
According to the National Federation of Independent Businesses (NFIB), it is inappropriate for the NLRB's to require all private employers to prominently display a poster on unionizing. NFIB has sued the NLRB and has argued that the NLRB lacks the authority to require over six million employers to post a notice in the workplace informing employees of their right to unionize. One court in South Carolina agrees with NFIB and other small business advocacy groups that the NLRB is overstepping its bounds with this ruling while a judge on the District Court for the District of Columbia says that NLRB is within its bounds to promote this ruling, but without the power to punish businesses for failure to comply. The NLRB is appealing both Court's rulings.
For listeners to Biz Talk With Josh Smith, the primary issue in this matter is what is the impact on small businesses if the NLRB is successful in implementing a rule requiring them to post a notice in the workplace informing employees of their right to unionize.
Tune in to Joshua Smith's radio show this Thursday when he will feature Ms. Karen Harned, Executive Director, NFIB Small Business Center, and Mr. Fred Horner, President & CEO, Advanced Industrial Roofing to discuss the this ruling and how it is perceived by the small business community.
