Greetings!

    "Let's shake on it!"  Negotiating a deal, sealed with a handshake, creates a win-win situation.  A judge or a jury has to come up with a winner and a loser.  And you certainly don't want to be the loser! 

    Almost all lawsuits end with a negotiated settlement not a trial.  So why go through all the expense and hassle of litigation when you can settle a case sooner? 
 
Resolve Multiple Claims Promptly

     Sometimes a high profile claim leads to copycat claims that lack merit.  The plaintiff may be trying to capitalize on a company that is already experiencing public relations distress.  The plaintiff may make veiled or not-so-veiled threats to "go public" with their claims.

     Multiple claims against a company may best be resolved as a group.  In fact, brokering multiple settlements can be cost-effective and provide consistent results.

     Start settlement talks early since a prompt effective settlement may discount your damages exposure. Consider too including non-monetary items in your settlement package.  Sometimes a heartfelt apology goes a long way to resolving a claim.  Find out what the complainant wants and try to accommodate reasonable requests.

          Set a respectful tone for your negotiation
          Negotiate easier terms first
          Steer clear of "deal breakers," or "last and final offers"
          Find out early what are the intangible as well as tangible demands
          Offer intangibles even if none are sought, they cost little
          Don't succumb to inflated dollar demands
          Ask for a breakdown of financial demands to see if they're supportable
