Prevent Claims! Tip
Choose your quarterback carefully.
November 28, 2007
Greetings!

No football team picks just anyone out of the lineup to be their quarterback, right?  Rather, they carefully choose the person best suited for getting the ball into the end zone.  That's what counts.  You should handpick the person to solve your company's problems with equal care.

Negotiation is just a fancy word for problem solving.
Doing it well, though, requires special skills.

Each of us tackle and solve simple problems all day, every day.  But to resolve complex problems, a special "quarterback" is needed.   A negotiator, adept at  overcoming resistance and obstacles, is a key member of any winning team.

A great negotiator is patient, yet quick to identify the parties' real needs and wants.  She quickly grasps the personalities - whether corporate or individual - and proposes creative settlements that appeal to the personalities  involved.  She achieves common ground with dispatch, and does not permit emotions to derail  consensus on tougher issues.   A great negotiator does not  countenance failure, and recognizes that humor is key to success.  Quarterback

Keep your negotiator on retainer, just like a valuable quarterback!

Just like you don't use a quarterback for every play, you won't use your negotiator for every problem that needs to be solved.  But, if you treat your negotiator like a team member, she'll know your playbook inside out when a challenging problem comes up.  And she'll solve it on time and under budget.

For a quick list of some of my favorite negotiations, see below.

Negotiated a permanent injunction against a federal agency,
the appointment of a Special Master, an inquiry into senior officials' misconduct, and backpay and an agreed-upon promotion for an individual client

Negotiated a financial settlement for multiple clients that was $ .25 million
under budget

Settled a threatened lawsuit against a corporate client for an apology

I look forward to serving you.

Cordially,

Beville
