ü        Investigate claims promptly and thoroughly.  Nothing rankles a jury more than a cover-up.

 

ü       Make your investigation letter perfect. Assume it will be scrutinized down the road.  After all, you will probably offer it as an affirmative defense.

 

ü       Follow every lead - even those that could hurt your company.  Remember, the only "bad" facts are the ones you don't know!

 

ü       Limit those in the loop to people with a true "need to know" to avoid defamation and invasion of privacy claims.
