The crisp air and the beauty of the changing leaves of fall are upon us. We hope you have time to enjoy them. Beauty and change are both important for a healthy life and a sound basic education.
As the seasons change, so do the laws and the way courts interpret them. Unfortunately, the facts, mistakes, and consequences giving rise to court cases are not so beautiful. We have more interesting developments to report in our special education e-law updates, available online. These include:
- An instructive negligent supervision case from the N.C. Court of Appeals involving an injury to an autistic child. The case is a good reminder of the importance of documentation and proper supervisory practices.
- An out-of-state court ruling rejecting a special education aide's attempt to sue school officials for not sufficiently protecting her from a child prone to violent behavior.
