John attended the COSTHA (Council on the Safe Transport of Hazardous Articles) Conference in Savannah, GA the week of April 23rd.

He obtained a lot of information to share with you.

"Thou Shalt Not Leak!!!"
|
Secondary Closures Rule
The US DoT / PHMSA has issued a final rule under HM-231A, which will require the closures of inner packagings within a combination packaging used for the transport of liquids by air to be secured by a secondary means of closure or, where this is impractical, to use a leak-proof liner. Most shippers are already preparing consignments in accordance with this program. Domestic ground shipments are not required to have this engineering. Shippers and forwarders need to be careful of what is going on inside the box.

New Limited Quantity Mark Applicability of the ORM-D System under 49CFR
In January 2011 PHMSA published the Final Rule for HM-215 K which includes the new limited quantity mark. This mark replaces the need for packages to be marked with the square point-on-point diamond with the appropriate UN or ID number centered in the diamond.
The new limited quantity mark will also replace the ORM-D and ORM-D-AIR mark. This change was authorized in 2011; however, there is a transition period for compliance until 12/31/2013 for shipments by highway, air and ocean.

*Note: Beginning January 1, 2014 the limited quantity hazardous material designation will no longer authorize the "consumer commodity/ORM-D" proper shipping name except those eligible and prepared for shipment by aircraft in accordance with §173.167 and using the newly adopted identification number "ID8000". Such packages are eligible for transportation by all modes but must be marked with the limited quantity "Y" mark prescribed in §172.315(b) indicating the package is suitable for air transportation.

Changes to Lithium Batteries Continue!!

Below is a summary of changes to be incorporated into the 54th edition of the IATA Dangerous Goods Regulations effective 1 January 2013 once approved by the ICAO Council. The 2013 regulations will require additional layers of detailed administration for classifying, identifying, packaging and documentation requirements.
These changes primarily concern
- Additions to Section II Lithium Ion (PI 965 II) and Lithium Metal (PI 968 II) cell and battery quantity limits per package.
- New Section "1B" for Lithium Ion (PI 965 1B) and Lithium Metal (PI 168 1B)

IATA Lithium Battery Guidance Document
IATA issued a Guidance Document in April that explains the current lithium battery requirements. Click here to review the IATA Lithium Battery Guidance Document Revised for the 2012 Regulations.
More changes coming with the 2013 IATA Dangerous Goods Regulations 54th edition this November.
We Could See ... ANOTHER CHECKLIST!
There is rumor that a new check list specific to lithium batteries may become mandatory.
The ICAO and U.S. air transportation working groups are discussing the adoption of a checklist to promote safety and communications during acceptance by carriers.

New Regulation Releases
The NEW Government DOT 49CFR has been released. It is now a 2 volume set, Parts 100-177 and Parts 178-199. Be sure your regulatory library is up to date.
 The 2012 Emergency Response Guidebook has been delayed until mid-June.

Are You Still Hazmat Certified?
Please be aware of when your last hazmat training occured. Recertification is required:
- ICAO/IATA/Air - every 24 months
- US DOT/49CFR - every 3 years
- IMO/Ocean - every 3 years
- AFMAN 24-204 - every 24 months
