Greetings!
You may have noticed our Airpack Newsletter is a little late arriving in your mailbox. That's because we have been very busy this first quarter. John has been all over the US training, finishing up with a trip to Europe where he conducted a training course on 49CFR and AFMAN 24-204 for a NATO agency affiliate. This is not Airpack's first international trip. September 2001 found us in Bermuda, assisting in closing down a NASA facility. In November 2007 John was in Albania assisting a hazmat clean up crew to pack up and come home in time for the holidays. The recent trip to Europe has expanded our horizons. Airpack can now offer training courses for ADR - The European Agreement Concerning the International Carriage of Dangerous Goods by Road. Hazmat Guru Corner "Lithium Battery Saga Continues"
During the first quarter of 2010, PHMSA published its Notice of Proposed Rulemaking (NPRM HM-224F) on Lithium Battery Requirements. The proposal is one of the most significant rulemakings PHMSA has produced in years. Airpack's Regulatory Compliance Manager, Winslow Sully, attended the HM-224F Public Hearing in D.C on March 5, 2010, and found that COSTHA (Conference on Transportation of Hazardous Articles) came to the PHMSA hearing with a lot of concerns. The COSTHA statements as submitted can be accessed here for your reference.
As many of you are aware, PHMSA requested comments on their Lithium Battery NPRM HM-224F (comment period ended Friday, March 12, 2010). COSTHA's submittal to PHMSA on March 10, 2010 is quite extensive and identifies significant impacts to nearly every industry represented in COSTHA. Comments have been submitted to the Docket Management System but can also be accessed here for your reference. They identified 10 areas of interest, including areas of support (e.g. new shipping names, watt hour adoption, UN 38.3 testing harmonization) and disagreement (e.g. design type testing, elimination of small battery exceptions by air, compliance date), and raise significant questions regarding the Cost/Benefit Analysis done to support implementation of the NPRM. Their submittal is an amalgam of comments received by their NAAHAC, Air Carrier Roundtable, Life Sciences groups as well as retail, distribution, and transport members.

Lithium Battery Course On IATA Regulations at the CTMA Conference in Portland, Oregan Airpack will be attending the 46th Annual Contractors Transportation Management Association (CTMA) Workshop being held in Portland, Oregon June 22-25, 2010. Adding to the other workshops the conference is offering we will be offering a Lithium Battery Course. The course will be taught by instructor Jerry Green and will cover lithium batteries as they apply to the IATA Dangerous Goods Regulations. Fraudulent Use of WPM (ISPM 15) Program Trademark |
There has been a rise in the number of cases of misuse or fraudulent use of WPM (ISPM 15) trademarks. This is a very serious matter. The Department of Agriculture began implementation of the heat treatment requirement of wood packaging materials in September 2005. The treatment is designed to prevent plant pest that can destroy domestic agriculture and livestock from entering the United States in wood packaging materials. The stamp certifies that the wood pallets have been treated. Heat treatment is not required for wood pallets that carry products transported within the United States.
January 8, 2010 a former vice president of a Texas based grocery wholesaler, pleaded guilty in federal court in El Paso, Texas, to one felony charge for falsifying stamps certifying that wood pallets were heat-treated to prevent infestation, and were suitable for use in international transportation.
The former vice president of the company was expected to direct the transfer of products destined for Mexico from untreated pallets to treated pallets. Instead he created a copy of a stamp certification utilized by a legitimate wood pallet treating company and had hundreds of untreated domestic pallets falsely stamped as if they were treated. Saving the time to transfer food and pharmaceutical products between pallets, as well as the cost of treatment.
However, the stamps that were created were smaller than the legitimate stamp. So when companies received the fraudulently stamped pallets from Mexico, and had to send them to the legitimate stamp owner for repairs, the legitimate stamp owner noticed the falsification and notified the government.
An investigation was held by the Department of Agriculture and resulted in the seizure of fraudulently stamped pallets at the U.S-Mexican border. It was prosecuted by the Justice Department's Environmental Crimes Section and the U.S. Attorney's Office for the Western District of Texas.
For the fraudulent misuse of the trademark stamps offense, the former vice president had to pay a fine of $8,000.00 and is serving a term of probation.
Each agency has the responsibility to protect its mark. It is important that abuse of registered trademarks be stopped. Please advise your clients to report any suspected misuse of WPM stamps to the office of the American Lumber Standard Committee by calling the office at 301-972-1700 or by e-mailing alsc@alsc.org. All reports are investigated and kept confidential. |

Have you heard of the Contemporary Supply Chain Packaging Course (CSCP)?
In partnership with the National Institute of Packaging, Handling and Logistics Engineers (NIPHLE) we hold a Contemporary Supply Chain Packaging Course here at our Airpack Training Center three times a year.
It is a systematic training program that installs familiarity with the general provisions of the fundamentals of Supply Chain Packaging concepts for products that are shipped domestically or internationally for the Department of Defense.
"When the government implements changes to Radio Frequency Identification, Unique Item Identifiers, Bar Coding, Shelf Life, Material Safety Data Sheets, Performance Oriented Packaging, Military Shipping Labels, Foreign Military Sales, and Metrication this causes those in this profession to keep up with the latest changes." says Roger Young one of the 3 instructors. "I had the pleasure to instruct the Contemporary Packaging Class in February 2010, the interaction between the students and the instructor lead me to constantly fine tune this course. While packaging remains the focus of our educational program, many programs associated with the package are the responsibility of the packaging professional to implement and understand when offering a shipment to the various modes of transportation to the industry or government customer."
