Winter/Spring Reminders...
Per the Illinois Condominium Property Act,
the Board
must perform specific annual duties
including, but not
limited to, those listed below. Be sure to check
your Declaration, By-Laws and with your
accountant for
specific requirements to ensure your
Association's
compliance.
? Annual Accounting To Owners: Itemized
accounting of common expenses for preceding year
actually incurred or paid, together with a
breakdown of
reserves, capital expenditure or repairs,
taxes, and
amounts
collected, etc. If December 31 is your fiscal
year-end, this
document should usually be sent to all owners of
record by March 31.
? Year-End Tax Returns: All
corporations must
prepare a year-end tax return within certain
timeframes. If December 31 is your fiscal
year-end,
your tax return will be due by March 15.
? Seasonal Reminders: Time to begin
researching your Spring landscaping, maintenance,
and seasonal projects. Proper due diligence and
negotiations take time or you'll wait in line for
scheduling when you should be
implementing the projects!

| New CO Law Effective 1/1/07 |

Act 094-0741/Carbon Monoxide Alarm Detector Act on the
Illinois General Assembly web site.
In brief, effective January 1, 2007, every dwelling
unit shall be equipped with at least one approved
carbon monoxide alarm in operating condition within
15 feet of every room used for sleeping purposes.
The carbon monoxide
alarm may be combined with smoke detecting devices
provided that the combined unit complies with the
respective
provisions of the administrative code, reference
standards and department rules relating to both
smoke detecting devices and
carbon monoxide alarms and provided that the
combined unit
emits an alarm in a manner that clearly
differentiates the
hazard. All owners should familiarize themselves
with the
additional requirements, exemptions, and
consequences of non-compliance.
Responsibilities: It is the responsibility
of the owner to supply and install all required
alarms within their dwelling unit. If the unit is
rented, the tenant also has specific duties to
perform. Although the law is written using
landlord/tenant language, association
boards/managers should inform their unit owners of
the new law, but may only be responsible to ensure
common area compliance, if applicable.
