Attorney Profile
LOU FLORA joined the firm in September of 2008. His experience in the area of public sector law and public projects is significant.
Lou has represented both private developers and municipal entities involving redevelopment projects, condemnation actions, public bidding and related solicitations such as RFP's and RFQ's, vacation of streets, affordable housing obligations, project labor agreements and prevailing wage issues. He also has a background in other areas related to land use and development, and has represented public entities, owners, and objectors in land use applications as well as challenges to approvals granted, and applications to the NJDEP for use of lands subject to Green Acres restrictions. Lou also has a background in construction law, as well as Alternate Dispute Resolution-he is a Court Rule qualified Rule 1:40 mediator as well. Why Pick Arbitration to Resolve a Dispute?
Typical construction projects are complex and lengthy, and given these variables, disputes among parties often occur. The cost and duration of disputes can be lessened significantly through planning of how disputes will be handled should they arise. The number of details considered in advance is directly proportional to the amount of control parties can exert over the management of the resolution process when and if necessary.
Contrary to litigation, alternative dispute resolution (ADR) allows parties the ability to plan early for possible disputes and the flexibility to customize the most time and cost effective resolution process for their case. This is accomplished by inserting an ADR clause in the dispute resolution section of the construction contract spelling out the terms of the resolution process agreed to by both parties. Even if a project is underway and bound an existing contract when a dispute arises, parties still can use ADR to their advantage.
