DCAB would like to thank Mr. Dan Burden, Executive Director of the Walkable and Livable Communities Institute for his April 17th presentation, Designing 'Complete Streets' for Persons with Disabilities.  This free presentation, hosted by DCAB, and sponsored by the Department of Health, DCAB and AARP, was attended by various members of the design community, government agencies and the general public.

 

Mr. Burden's presentation discussed ideas on how our communities could be developed to be more walkable, sustainable and thus more enjoyable for all.  Attendees enjoyed the many examples and images Mr. Burden shared of other communities that have incorporated the design ideas discussed.

DOJ Delays Effective Date for ADA Requirements Covering Existing Pools and Spas
 
Effective March 15, 2012, the compliance date for the 2010 Americans with Disabilities Act (ADA) Standards for Accessible Design as it relates to the provision of accessible entry and exit to existing swimming pools, wading pools, and spas is extended to May 21, 2012.  In addition, the Department of Justice (DOJ) is considering a longer extension to allow pool owners and operators to meet their ADA obligations.

DOJ Webinars for ADA Requirements for Pools
 
DOJ will be hosting free webinars to provide information and technical assistance about ADA requirements as they relate to existing pools.  The first webinar will focus on pool access provisions that apply to places of public accommodation, such as hotels and motels.  The second webinar will focus on pool access provisions that apply to state and local government entities.

Proposed Standards for Medical Diagnostic Equipment
 
The U.S. Access Board has released for public comment accessibility standards for medical diagnostic equipment.  The proposed standards address access for people with disabilities to examination tables and chairs, weight scales, mammography equipment, and other equipment used for diagnostic purposes.  The deadline for comments on the standards is June 8, 2012.  The proposed standards and information about submitting comments are available at http://www.access-board.gov/mde/nprm.htm.

Frequently Asked Question
 
Q:  When swimming pools are provided as a public and common use amenity, what are the accessibility requirements under the Fair Housing Act?

A: 
Requirement 2 covers recreational facilities such as swimming pools.  Fair Housing Act Design Manual, Chart 2.4 Diagram 2.8.  A swimming pool must be located on an accessible route, but there is no requirement that an accessible route be provided into the pool.  In addition, a door or gate accessing the pool must meet Requirement 3 and the route must provide access to the deck around the pool.
