The U.S. Access Board is responsible for issuing accessibility standards for free-standing medical diagnostic equipment and has released their proposed standards for public comment earlier last month.  The proposed standards address access for people with disabilities to examination tables and chairs, hospital beds, weight scales, mammography equipment, and other equipment used for diagnostic purpose.  The deadline for comments on the standards  is June 8, 2012.  The proposed standards are available for viewing at  http://www.access-board.gov/mde/nprm.htm.

DOJ Publishes Guidance on Accessible Pools
 
The Department of Justice (DOJ) has a new technical assistance document about Accessible Pools - Means of Entry and Exit.  This publication is designed to help pool owners and operators understand how new accessibility requirements apply to new and existing pools.  Other issues discussed include compliance dates, maintenance of accessible features, staff training, and tax credits and deductions.  This document is available at http://www.ada.gov/pools_2010.htm.

In addition, the DOJ issued a letter to the American Hotel and Lodging Association, which responds to questions regarding their obligations to remove architectural barriers in existing facilities, particularly those obligations pertaining to swimming pools and spas.  The letter clarifies the DOJ position about the use of a portable pool lift.  The DOJ states, "If, in our example, an entity chooses to use a lift complying with the 2010 Standards that is removable or otherwise designated as "portable," it may do so, so long as while the lift is provided at the pool, it is affixed in some manner to the pool deck or apron."  The entire letter is available at

 

ADA Checklist for Readily Achievable Barrier Removal
 
The Americans with Disabilities Act (ADA) requires public accommodations (businesses and non-profit organizations) that serve the public to remove architectural barriers when it is "readily achievable" to do so.  The New England ADA Center has issued an updated version of its ADA Checklist for Readily Achievable Barrier Removal based on the 2010 ADA Standards for Accessible Design.  This checklist is intended to assist public accommodations as the first step in a planning process for readily achievable barrier removal.

Q:  Under the Fair Housing Accessibility Guidelines, must the clear floor space at bathroom lavatories be centered on these fixtures?

A: 
In bathrooms, both forward and parallel approaches to lavatories are allowed and must be centered on the fixture as shown in the Fair Housing Accessibility Guidelines, Figure 7(c).  If a forward approach is provided, knee space must be provided below the lavatory.
