Proposed Guidelines for Accessible Public Rights-of-Way: Comment Period Extended
 
The U.S. Access Board has reopened the comment period on its proposed guidelines for accessible public rights-of-way to February 2, 2012.  The original comment deadline was November 23.  This action is being taken in response to requests from interested parties, including government and trade associations, for additional time to submit comments on the rule.

The proposed guidelines provide design criteria for public streets and sidewalks, including pedestrian access routes, street crossings, curb ramps and blended transitions, on-street parking, street furniture, and other elements.  The U.S. Access Board is seeking public input about impact on transportation departments, unintended positive and negative consequences of the proposed guidelines, curb ramps, detectable warnings, accessible pedestrian signals, signs, tabling newly constructed intersections, and other topics.  The guidelines are available at http://www.access-board.gov/prowac/nprm.htm.

Q:  Do the Fair Housing Act's design and construction requirements apply to alteration or renovation of properties?

A:  Alterations, rehabilitation or repair of covered multifamily dwellings are not covered because the Act's design and construction requirements only apply to new construction of buildings built for first occupancy after March 13, 1991.  However, a covered multifamily dwelling that has been constructed to comply with the law cannot later be altered to make it non-compliant with the law.  Additions for four or more units are covered by the design and construction requirements.
