DOJ Publishes 2010 ADA Standards for Accessible Design
 

The Department of Justice's (DOJ) 2010 ADA Standards for Accessible Design and Guidance on the 2010 ADA Standards for Accessible Design is available for download from the DOJ's website.  It provides scoping and technical requirements for new construction and alterations of public and private buildings, facilities, and sites covered by the ADA.  The documents can be downloaded at: http://www.ada.gov/2010ADAstandards_index.htm.


 
REMINDER: DCAB to Review State and County Projects to 2004 ADAAG


To be consistent with the DOJ's 2010 ADA Standards for Accessible Design, DCAB adopted the 2004 ADAAG with an effective date of January 1, 2011.

All plans and specifications for the construction of public buildings, facilities, and sites submitted to DCAB on or after January 1, 2011 will be reviewed for compliance with the 2004 ADAAG.

Plans and specifications submitted to DCAB before January 1, 2011 may be reviewed to the 2004 ADAAG if the department managing the project submits a written request.  Plans and specifications submitted to DCAB on or after January 1, 2011 may be reviewed to the 1991 ADAAG if the department managing the project submits a written request that includes a statement that construction will start before March 15, 2012.

DCAB Issues New Interpretive Opinions

An Interpretive Opinion issued by DCAB is clarification of a particular design standard, and only applies to State and County construction projects subject to HRS §103-50.  In January, DCAB ruled on twenty (20) Interpretive Opinions on accessible routes, walking surfaces, toilet and bathing facilities, doors, parking spaces, public right-of-way, etc.  DCAB simultaneously rescinded all Interpretive Opinions issued by DCAB prior to January 1, 2011.  All new Interpretive Opinions can be viewed or downloaded at http://www.state.hi.us/health/dcab/interpretiveops/.

Webinar and Audio Conference a Continuing Series

Learn more about the work of the U.S. Access Board's and DBTAC's continuing series of monthly webinars and audio conferences.  General attendance is free, but a $25 fee will be charged for processing CEUs.  Upcoming sessions include:

City and County Ordinance Pedestrian Use Zone

The City and County passed Ordinance 10-16 that defines a pedestrian use zone and states that no person may deposit, install, place, fix, or leave any object or item in, on, or above the pedestrian use zone.  This Ordinance is applicable to selected urban areas of Ala Moana/Kakaako, Downtown, Kalihi, McCully/Moiliili/Makiki, and Waikiki.  It provides a $50 penalty and the ability to impound property illegally stored in this zone.  There are exceptions: medical emergency, performing a government function such as repair and maintenance, sitting on a public bench, participating in a permitted activity such as a parade, waiting in a line, waiting for a bus, or actively moving freight.  Although the purpose of the bill may have been to address the homeless situation, DCAB provided testimony in support of this bill because it was the effect of maintaining a clear, accessible route in the public right of way for persons with disabilities.

Accessible Equipment and Furniture
 

The DOJ is reviewing the accessibility standards for equipment and furniture.  DOJ's goal is to ensure that equipment and furniture used by public and private entities are accessible to individuals with disabilities.  The advanced notice of proposed rulemaking (ANPRM) seeks public comment on several categories of equipment and furniture that pose challenges to individuals with disabilities, including medical and exercise equipment and furniture, beds in hotels and medical facilities, golf cars, ATMs, and point of sale devices.  Comments must be sent to the DOJ on or before January 24, 2011.  DCAB is currently reviewing the ANPRM and plans to send comments to the DOJ.

 FAQ

Q:  If a required accessible route has a slope of more than 5%, is this portion of the route a walkway or a ramp?

 

A: It is a ramp and must meet the requirements for ramps, including slopes not to exceed 8.33%, handrails on both sides, edge protection, and comply with all other applicable specifications.
