ADA Titles II and III Notice of Proposed Rulemaking by the DOJ
 
The U.S. Department of Justice (DOJ) is proposing to amend Titles II and III of the Americans with Disabilities Act.  The proposed rules intend to adopt the revised 2004 ADA/ABA Accessibility Guidelines issued by the U.S. Access Board.  In addition to adopting the "new ADAAG" the rules discuss how to interpret what is 'program access,' in Title II facilities and 'readily achievable barrier removal' in Title III facilities. The rules also provide additional regulatory guidance on a number of key program and service issues.  The proposed rules are fairly lengthy and can be found on the DOJ's web site at www.ada.gov.
 
DCAB has completed two lengthy analyses of the proposed rules. Part 1 of the 2 part analysis discusses those proposed changes in either Titles II or III that are not related to the adoption of the new ADAAG.  These include: service animals, ticketing in stadiums, captioning in movie theaters, emergency public address systems in stadiums, communication access services such as video remote interpreting, reservations for accessible rooms in hotels, and accessible time shares or vacation units.  Part 2 of the 2 part analysis discusses the adoption of the 2004 ABA/ADA Accessibility Guidelines in place of the current 1991 version.  Part 2 includes recommendations regarding access to stages in auditoriums, accessible witness stands, assembly area assistive listening systems, accessible recreation facilities (such as golf course routes, swimming pools, play areas, etc.), accessible residential facilities, accessible patient rooms in medical care facilities, accessible cells in detention and correctional facilities, and the effective date triggering event.  Both analyses state DCAB's position on the proposed changes.
 
The DCAB Board, at its July 17, 2008 meeting, approved the recommendations in both analyses.  The deadline for comments to the DOJ is August 18, 2008.

ICC/ANSI A117.1 2008 Edition
 
In June, the International Code Council (ICC) issued its 'Second Public Draft' of the 'ANSI A117.1 Standards on Accessible and Usable Buildings and Facilities 2008 Edition' for public comments.  DCAB reviewed the ICC's Second Public Draft and issued ten (10) comments on July 1, 2008 to the ICC. FAQ - ADAAG
 
4.5 Ground and Floor Surfaces
 
Question:
Is there a specific coefficient of friction required for a surface to be "slip resistant"? (ADAAG 4.5.1)
 
Answer:
No. There are a variety of ways to measure the coefficient of friction for different materials and no single test device or procedure has been identified.  A Board sponsored research project, described in the ADAAG Appendix Section A4.5.1, suggested some values but, without defined test procedure, these recommendations cannot be applied.
