Current Interpretive Opinions
 
In July the Standing Committee on Facility Access ruled on one Interpretive Opinion, which applies to buildings and facilities subject to HRS §103-50, regarding ADAAG Section 4.11 Platform Lifts (Wheelchair Lifts).:

2008-06:  The technical requirements of the 2004 ADA/ABA AG, Section 410 Platform Lifts, provide equivalent facilitation to the technical requirements of the ADAAG, Section 4.11 Platform Lifts (Wheelchair Lifts).

Updated Summary of Interpretive Opinions

DCAB has updated the Summary of Interpretive Opinions, which is a compilation of interpretive opinions issued by DCAB from 1990 to 2008. 

Pursuant to §103-50, Hawaii Revised Statutes (HRS), all buildings and facilities constructed by, or on behalf of the State or any county, shall conform to the Americans with Disabilities Act Accessibility Guidelines and the requirements of the Fair Housing Amendments Act Accessibility Guidelines as adopted and amended by the Disability and Communication Access Board (DCAB). In accordance to HRS §103-50 and Chapter 11-217, Hawaii Administrative Rules, DCAB has authority to issue interpretive opinions for the purpose of clarifying design requirements for State and county construction projects that are covered by HRS §103-50.

4.3.11 Areas of Rescue Assistance

Q: When are areas of rescue assistance required?

A: In new construction, ADAAG requires accessible means of egress in the same number as required for exits by the local life safety regulations. Where direct exit discharge cannot be provided, such as from floors above or below grade, areas of rescue assistance are required, unless a supervised automated sprinkler system is provided. They are not required in altered buildings.
