On behalf of DCAB we wish you a happy and prosperous 2008!  As the year progresses we are excited about the positive changes occuring in our community included in our Access E-Bulletin, such as the Statewide Model Building Code and the 2008 Accessible Design Conference. 

We look forward to a great year of keeping you updated on the current accessible guidelines, trends and events occuring locally and nationally.

Statewide Model Building Code
 
With the passing of legislation this past 2007 session, the State has formed a State Building Code Council that is tasked with adopting a Statewide Model Building Code.

The Building Code Council is currently reviewing the International Building Code (IBC) 2006 edition as its model. DCAB has completed a review and analysis of the IBC 2006 accessibility sections in comparison to the accessibility guidelines required for State and County Buildings per Hawaii Revised Statute (HRS) §103-50, which are the Americans with Disabilities Act Accessibility Guidelines (ADAAG), The Fair Housing Act Accessibility Guidelines (FHAAG) and the State Residential Housing Accessibility Guidelines (RHAG).

Where sections of the IBC 2006 appeared less stringent than the guidelines mandated by HRS §103-50, DCAB drafted proposed amendments to the IBC 2006.  These proposed amendments were forwarded to the chairperson of the State Building Code Council in December for the council's consideration when drafting their amendments to the IBC 2006.

County of Hawaii Ordinance
Bill 51/151

In November 2007, DCAB reviewed Hawaii County Bills 51 and 151 relating to zoning and provided testimony to the Hawaii County Council.  DCAB supported Bill 51 as it appeared to be consistent with State and Federal Requirements and as written would bring Hawaii County into compliance with the National Flood Insurance Program.

DCAB's written testimony on Bill 151 was in opposition to the bill as written.  DCAB felt the bill, which required all homes within Zone X shaded and unshaded to be raised one to two feet, was ambiguous and overly broad in its definitions, did not allow access for the disabled, or for aging in place, and added additional costs to developers and home owners.

Outdoor Developed Areas Accessibility Guidelines

The U.S. Access Board issued a Notice for Public Rulemaking on the Proposed Architectural Barriers Act Accessibility Guidelines for Outdoor Developed Areas in 2007. The guidelines would apply to sites developed or altered by Federal land management agencies, including the U.S. Forest Service, the National Park Service, the Fish and Wildlife Service, the Bureau of Land Management, and the Army Corps of Engineers.

DCAB's Facility Access Unit reviewed the Proposed Guidelines for Federal Outdoor Developed Areas and compared them to the Americans with Disabilities Act Accessibility Guidelines (ADAAG) and the Americans with Disabilities Act/Architectural Barriers Act Accessibility Guidelines (ADA/ABA AG). DCAB provided comments in October to the U.S. Access Board based on their review.

Interpretive Opinions

In 2007, DCAB issued one Interpretive Opinion as follows:

DCAB 2007-01: ADAAG Section 7.2(2) Sales and Service Counters, Teller Windows, Information Counters.  Rescind Interpretive Opinion AAC 93-52.552.

In summary, there appeared to be a conflict between the height requirement in Interpretive Opinion AAC 93-52.552 and ADAAG section 7.2(2) as 'reception counters' can be viewed as a type of 'service counter' or 'information counter'.
