Clark Wilson Discusses the Recent Patent Law Reform Act at the November Section Breakfast Meeting | |
Those who attended the November Breakfast meeting learned about the recently-passed Patent Law Reform Act, officially titled "The America Invents Act." The speaker was Clark Wilson, a patent attorney with the intellectual property boutique firm Gardner Groff Greenwald & Villanueva PC. For reference, the changes to the patent laws mark the first major update since 1952. And, while many of the amendments are of particular interest only to patent attorneys, there are some aspects which all business-focused attorneys can benefit from understanding. First, and most widely publicized, is the landmark shift to a "first inventor to file" system of patent rights ownership. Previously, the USA had maintained its position as the only nation on the planet using a "first to invent" system. This old system allowed patent rights to be acquired by the first true "inventor" regardless of the date on which he/she filed a patent application. The process for determining who "invented" something first was often complicated, expensive and unreliable. Under the new system, set to begin on March 16, 2003, if two inventors both invented the same invention independently, it is the one who files a patent application first who will be awarded the patent rights.
