Brownfields Coalition Joining Forces with Smart Growth America

Look for an announcement tomorrow - the National Brownfields Coalition and Smart Growth America have established a new alliance, with the Brownfields Coalition joining Smart Growth America.  Both organizations will be strengthened by combining
expertise and public policy involvement, while making the connection between brownfields and related community reinvestment and sustainable growth issues.

This Newsletter will be transferred over to Smart Growth America.  All existing recipients will be automatically included in the new-look SGA-Brownfields Coalition newsletter.   
 
The Brownfields Leadership Circle will continue to support the Coalition's work with Congress.  

 

Bill to Establish "Brownfield Renewal Authorities" Proposed in Washington State

   

SB 6211 "Accelerating Cleanup of Hazardous Waste Sites" was introduced in the Washington state legislature. Following up on the recommendations of the "Washington State: Brownfields Policy Recommendations" report, the bill makes wide-ranging changes to the Washington brownfields program.  

One key proposal would grant a series of powers and enhanced incentives to newly authorized Brownfield Renewal Authorities (BRAs). BRAs would have the power to acquire land and issue bonds, but would additionally benefit from:

  • The ability to access privately held brownfields for the purpose of performing an environmental site investigation;
  • Priority for funding for areawide groundwater grants and for adaptive reuse planning grants;
  • The Prospective Purchasers of sites located in BRAs may be granted limited liability protection under an administrative order (a less cumbersome process, relative to consent orders or Prospective Purchaser Agreements);
  • Prospective Purchasers of sites in BRAs are eligible for financial assistance if the project involves expanded public access, new recreational facilities, environmental restoration, or historic preservation.

Elimination of California Redevelopment Agencies Upheld - Big 10 Mayors Cite Brownfields in Appeal to Governor 

   

The California Supreme Court upheld the Legislature's power to eliminate redevelopment agencies throughout the state but struck down a bill that would have allowed redevelopment to continue, provided that a portion of the incremental taxes is funneled to schools and special districts. This worst-case scenario for urban redevelopment is causing new attention to the need to replace the former program with a new approach. See the following:

Brookings Cites Ohio Model for Rustbelt Revitalization       

 

The Brookings Metropolitan Policy Program, in a special article for Atlantic Cities, cites the Partnership for Regional Innovation Services to Manufacturers, PRISM, as a potential model for rustbelt economic revitalization strategies.  The Northeast Ohio program, developed by the Manufacturing Advocacy and Growth Network (MAGNET) is described this way: 

"Regional leaders came together to launch the initiative... to help small and medium-sized manufacturers in old commodities industries, like steel and automotive, reinvent their products and business models to take advantage of growth opportunities in emerging markets like bio-science, health care and clean energy...  PRISM brings together higher education institutions, regional economic development organizations, and Ohio's Edison Technology Centers to provide market research and business consulting services, increase firms' access to capital and talent, and foster stronger relationships within growing industry clusters."

 

Ohio Launches New Brownfields Action Plan Pilot Program

 

From the Smart Growth America newsletter: "The Ohio Department of Development (ODOD) announced last week six communities that will participate in the state's innovative Brownfields Action Plan Pilot Program, a new initiative designed to help communities with multiple brownfield sites create area-wide plans to address them. ODOD launched the program in August of last year and selected the pilot communities after a four-month application and review process. The chosen communities will each receive technical assistance and a $50,000 grant to develop and implement their area-wide plans." The innovative program uses income from Ohio's Brownfield Revolving Loan Fund (funded by EPA) with federal Community Development Block Grant funds. Read more here.


Connecticut Proposes "Transformation" of State Brownfields Programs

The Connecticut Department of Energy and Environmental Protection issued a "Report to the Governor and the Joint Standing Committees... Comprehensive Evaluation of the Connecticut Cleanup Program and Proposal for Transformation."  The report proposes a revamped brownfields regulatory program, including consolidating several current programs.  The report also calls attention to the need to reduce the time frames for review of cleanup plans.  The report is raising expectations that "Change in state brownfields laws could stimulate development."

 

Oregon Adopts Liability Reforms

In 2011 the Oregon Legislative Assembly passed liability reforms to make it easier to clean up brownfields.  Under HB 3325, prospective purchaser liability protection becomes available through an Administrative Order; whereas protections were only available through a more cumbersome Consent Order process prior to passage of the bill.
