The Arc of Aurora (CO) advocates for and with people with intellectual and/or other developmental disabilities and their families through individual and systems change advocacy, training and education, and individual, family and class support.

We in Aurora, CO, will be facing a new district attorney in our local judicial district:  the current DA is term-limited, so whichever candidate wins, we will have a new DA.  How exciting this opportunity will be, to work with a new leader charged with ensuring legal justice for victims, including those with intellectual and developmental disabilities (I/DD).  We have been educating ourselves and our membership via a Candidate Forum, excerpts from which are posted on youtube for those who could not attend the live Forum, about each candidate's plans to uphold justice, including justice for victims with I/DD.

Voting is one of the many privileges of living in our United States, yet as my advocate colleagues often say, with privileges come responsibility.  As advocates working to help ensure justice, we encourage and applaud your commitment and responsibility to ensuring justice and support for victims with I/DD.

Sign Up for NCVRW Guide and Poster

National Crime Victims' Rights Week (NCVRW) will be observed April 21-27, 2013. Sign up by November 30, 2012, to receive a free copy of the 2013 NCVRW Resource Guide and theme poster. Subscribers will also receive announcements and updates regarding the 2013 NCVRW.

Justice for child victims with disabilities

A conference for service providers and other professionals to understand and assist children with disabilities who are victims of abuse. This conference is for prosecutors, victim witness advocates, law enforcement, medical and mental health professionals, CPS/social workers, forensic interviewers, child advocates, tribal members and service providers, judges, resource officers and educators. There will be up to 14 credits/hours have been approved by Growing Futures (Daycare), North Dakota Board of Counselor Examiners, North Dakota Board of Social Work Examiners and the ND POST Board. Registration is required.

Disabilities Curriculum Available in English and Spanish

Crime victims with disabilities may face challenges that other victims do not face, such as the ability to access services or communicate with advocates. Supporting Crime Victims With Disabilities, a new OVC instructor-led training, focuses on recognizing and addressing these challenges so that all victims with disabilities receive the support and assistance they need.

 

New Census Report on Americans with Disabilities

The U.S. Census Bureau has released a new report, "Americans With Disabilities: 2010."   The report finds that approximately 57 million Americans of the 303.9 million in the civilian non-institutionalized population have a disability, with more than 38 million reporting the disability as "severe."  About 4 in 10 working-age persons with a disability were employed, compared to 8 in 10 working-age persons without a disability. Adults with severe disabilities were about twice as likely as adults with non-severe disabilities to experience long-term poverty, defined as poverty lasting for over 2 years. The definition of disability used in this report differs from the definitions used in other surveys, and the Census Bureau notes that caution should be used in comparing across different data sources.

Report Summarizes Crime Victimizations Not Reported to Police

The Bureau of Justice Statistics (BJS) has released Victimizations Not Reported to the Police.  This report presents findings for a five-year period from 2006 to 2010, on the characteristics of crime victimizations that went unreported to police, according to data from the National Crime Victimization Survey.

 

American Bar Association 

The American Bar Association (ABA) has resolved to increase training and awareness of FASD and to encourage academic and legal professionals to identify and respond to Fetal Alcohol Spectrum Disorders (FASD) within their professions. The ABA has committed to reviewing and implementing laws and adopting policies that acknowledge and effectively serve the FASD community.  Resolution, American Bar Association, August, 2012

St. Paul Man Sentenced to 13 Years for Raping Vulnerable Adult

A St. Paul man will spend over a decade in prison for sexually assaulting an 18-year-old girl in his charge at an adult foster care home in Burnsville. (Although there is no specific mention of boys with disabilities in the above article, many kids with disabilities attend these programs. Although there have been "whisperings" of abuse among scouting clubs, this is one instance of a cover up nationally over two decades. Another reason to make sure that wherever children with disabilities are, risk reduction strategies are employed.)

A 30-year sentence was handed down to a 23-year-old Anaheim man convicted of raping and sexually assaulting a severely disabled woman in the bathroom stall of a community college. Raul Barrientos, 23, was sentenced Monday after being convicted of leading the 19-year-old woman inside a restroom at Fullerton Community College, then leaving her there after raping and sexually assaulting her.

 

Court Approves Comprehensive Agreement Between US and the Commonwealth of Virginia Regarding the Rights of Individuals with Intellectual and Developmental Disabilities

The U.S. District Court for the Eastern District of Virginia has approved a comprehensive settlement agreement between the United States and the Commonwealth of Virginia, resolving the department's findings that Virginia's system for serving people with intellectual and developmental disabilities violated the Americans with Disabilities Act (ADA). The department had found that Virginia was violating the ADA requirement, as interpreted by the Supreme Court's decision in Olmstead v. L.C., to provide people with intellectual and developmental disabilities the opportunity to live and receive services in the community.
