Jul. 10th, our next webinar, How to Negotiate Licensing Deals Part 1 will feature a special guest, Mr. Andrew Berger, an IP attorney.  This webinar will cover how to negotiate the key terms, the pros and cons of third party negotiators, and four real - world negotiating strategies.  On Sat. July 14th, I'll be a featured speaker at the Marketing Secrets One Day Workshop  in Ft. Washington, PA, where I'll be teaching the "licensing secrets of the pros" and how you can use these secrets to make a fortune with intellectual property.  And on July 21st and 27th, I'll be hosting a one day live seminar at the Anaheim Business Expo Center, How to Make Money with Your Intellectual Property.  This seminar will cover Licensing and IP Basics, Smart Strategies for Managing IP, Bringing IP to Market, Royalties and Ideas for Making Money, Case Studies and Interactive Deal Negotiation by Participants.  And last but not least, this months licensing question is "How can I get a fast start with an international licensing deal and avoid legal pitfalls at the same time?."

Licensing Teams

There are plenty of opportunities in today's market and they are constantly evolving - whether it's in niche markets, new ways of distribution, or a shifting retail environment. Licensing is the tool that connects the IP with the expertise and knowledge to take advantage of these markets and money-making opportunities.

 

Licensing creates teams of professionals and it does that in three ways. First there are the idea people who create the intellectual property. These include the businesses and individuals who invent the IP. The second are the professionals, such as agents and consultants, who spot the licensing opportunities. I fall into this category. I assist my clients in making money with intellectual property, either as an agent licensing out rights to an IP, or as a consultant advising on acquiring rights to an IP. The third are the manufacturers who commercialize the intellectual property.   Depending on the IP, these could be one or more manufacturers or marketing companies.  

 

Bringing together these teams - better known as "commercialization teams", is a goal of licensing. The licensing process "captures" a wide variety of expertise and knowledge, and focuses it on making money with the intellectual property. 

Leveraging IP: A Faster Way to Building Business
Licensing is Profit

For ongoing businesses, finding more customers and increasing sales is a continuous challenge. In both cases you can use Licensing, which can be done in less time and for less money than starting from scratch. Here are 7 reasons why:

  1. Profit Potential - Licensing can generate substantial profits from the initial license fee and on-going royalties or service fees.
  2. Licensing Partners - Licensing creates motivated partners who have invested their money and time into successfully commercializing the IP.
  3. Market Expansion - Licensing can develop new markets using the financial and managerial resources of the licensees.
  4. Business Expansion - Licensing eliminates almost all of the costs normally associated with launching new products or opening new distribution channels.
  5. Lower On-Going Expenses - The expenses involved in managing multiple licensees are much lower than marketing the products directly.
  6. Marketing Advantages - Licensors can reduce marketing costs and benefit from the combined marketing activities of all the licensees.
  7. Economies of Scale - The more licensees a licensor has, the greater the number of customers and the larger the amount of revenues that can be generated from the IP. 

Licensing creates wealth and can be lucrative for all types: creative people who provide the ideas, business people who promote the ideas and bring products to market, and agents who spot new opportunities and act on them!

Q.How can I get a fast start with an international licensing deal and avoid legal pitfalls at the same time?

A.You can start with a small license, such as a single product for example. This could be from an inventor who has created an innovative new product. This makes sense especially if you are an entrepreneur or business owner with the international experience, skills and marketing savvy. Another option is to license international rights from a big US brand or company. Sometimes these rights are easier to get because of the nature of the international market being smaller. The legal pitfall of international licensing is not having a thorough understanding of what's in the licensing agreement. My suggestion is to use the services of a good IP attorney or licensing agent. It's always best to pay for the services of a good IP attorney just to read through the licensing agreement and make sure you understand everything that's in there before you sign off.
