Changes to Qualified Child
There is a new definition to what it means to be a qualifying child. These
changes result from the Fostering Connections to Success and Increasing
Adoptions Act of 2008 and are effective for the tax years beginning after
December 31, 2008.
* The qualifying child must be younger than the taxpayer claiming the
child.
* The qualifying child must not have filed a joint return other than for the
claim of refund.
* A taxpayer other than the parents of a qualifying child is allowed to
claim the child, but only if the taxpayer's AGI is higher than the highest
AGI of any parent of the child.
