One of the most disturbing letters you may receive is a letter from the DOL that says your company has been "selected" to be audited....are you prepared?
 Greetings!

Audits of this nature are usually triggered by a disgruntled employee(s) or specific industry being targeted for investigation.  An audit will result in a visit from the DOL  to review up to three years of records such as appropriate job descriptions, I-9 information, payroll records, position classifications (exempt vs non exempt), posters etc !  You must be sure such records are organized and up to date!  Be proactive! Don't wait for this dreaded letter!
 
In 2004, the agency collected $197million in back wages for more than 280,000 workers (BLR report). You hear more about these audits now that the state is cracking down on violations and seeking sources of increased revenue! 
 What can you do? 
 
The worst thing you can do is IGNORE it!
 
  • Be proactive! HAVE A SELF AUDIT CONDUCTED - Consider hiring a consultant to do an HR audit for your organization.
  • Position descriptions must be appropriate and compliant not only to support wage and hour laws but to support ADA laws;manybusinesses believe their descriptions are good and compliant, I have found that most are not!
  •  Positions must be classified properly! exempt and non exempt  is  most misunderstood; this is not based on opinion but rather strict criteria to be used to determine proper status
  • Assess your classification of "independent contractor"  another overused status that is resulting in fines and non compliance for many businesses/organizations
  • Assess payroll practices - watch for invalid pay deductions for salaried employees, timesheet discrepancies, employees working "off" the clock
  • Idenitify errors on your own and begin paying back anything owed to employees before such violations are found
     
    OBVIOUSLY THE WAY TO SURVIVE SUCH AUDITS IS FULL COMPLIANCE.  DON'T UNDERESTIMATE THE NEED FOR HR EXPERTISE!  DON'T ASSUME YOU ARE FINE! hAVING THE AUDIT IS CRITICAL TO MOVING TOWARD COMPLIANCE!
