ADA Amendments Act of 2008 - Final Regulations Released
The ADA Amendments Act of 2008 (ADAAA) was enacted on Sept. 25, 2008, and became effective on Jan. 1, 2009. The ADAAA made a number of significant changes to the definition of "disability" under the Americans with Disabilities Act (ADA). The ADAAA's changes to the definition of "disability" are intended to make it easier for a person seeking ADA protection to establish that he or she is disabled. In making these changes, Congress overturned several U.S. Supreme Court decisions that Congress believed interpreted the ADA definition of "disability" too narrowly.
Congress directed the Equal Employment Opportunity Commission (EEOC) to amend its ADA regulations to reflect the changes made by the ADAAA. The EEOC released final regulations under the ADAAA on March 25, 2011, which will become effective on May 24, 2011.
