Continuing Education Requirements Back in the Arena
HBAGTA Hosting Mandatory Seminars in April
While it appears that we have been on a veritable merry-go-round regarding continuing education requirements, it appears that DELEG has finally gotten off their "high horse" and actually mapped out a route than actually is going somewhere- not necessary around in circles! (Whoa there. . . I only intended a play on words - not an insult!)
For builders whose licenses expire in May, 2011, it is important that you pay especially close attention to the requirements. A full explanation of the Continuing Competency Requirements (updated March 16, 2010) is available on our website at www.hbagta.com. There was preliminary communication from some who were attempting to interpret the law. They alleged that Newer Builders would be given a break if their license expired next year. However, recent information just posted from DELEG indicates otherwise. In a nutshell, here's what is mandated:
1.) Newer builders (those with less than 7 years of experience) are required to have 21 clock hours of approved continuing education courses before the end of their license cycle.
2.) Experienced builders (those with 7 or more years of experience) are required to have 3 clock hours of approved continuing education specifically in safety, codes and legal issues.
3.) The dividing line between needing 21 hours of instruction and 3 hours of instruction boils down to the 7th year. If a person was licensed prior to January 1, 2009, they need only take the 3 clock hours regardless of how long they have had their license. If they were licensed on or after January 1, 2009, they will need 21 hours of instruction until they have been licensed for a full 6 years.
On Thursday, April 22nd, our association will host two 3-hour seminars for Experienced Builders. Two options are available to accommodate busy schedules. The seminars are to be held from 2-5 p.m. or 6-9 p.m. at the HBA office. Registration forms are available on the HBA website. The cost of the seminar is $59 for HBA members and $99 for non-members.
On Friday, April 23rd, the association will host a 6 hour continuing education seminar, segmented in to two 3-hour modules. The topics include MIOSHA Safety and Michigan Residential Codes. The cost is $49 per module or $98 for the whole day for HBA members. Non members will be charged $69 per session or $105 for the entire day. The Builder Forum at 4:30 p.m. will be presented by our HBA president, Rob Whims, attorney, who will be covering "Liens, Risks and Contractual Considerations" for builders. Please mark your calendars now and remember to RSVP. Spring break and Easter are fast approaching and it will be mid-April before you realize it. Consider bringing a potential member and share the camaraderie of a wonderful networking night with colleagues.

UPDATES AND SAFETY REMINDERS FROM THE "CODE GURU", ROGER PAPINEAU |

With the recent change to daylight savings time, many homeowners are prompted to consider annual home repairs and maintenance that they might have neglected over the long winter season. This is an excellent time to check and upgrade your smoke alarms and carbon monoxide (CO) devices.
Smoke alarms 10 years old or older should be replaced. Newer smoke alarms should have the battery replaced yearly unless the battery is a multi-year type (5 year or 10 year). Smoke alarms should be tested weekly and cleaned monthly.
CO devices should have the battery replaced annually, when present, unless the batteries are a multi-year type (5 year). Devices which are 2 to 7 years old should be replaced in accordance with the manufacturer's recommendation. CO alarms should also be tested weekly and cleaned monthly.
Public Act 65 of 2004 (and Section R313.4 of the 2006 MRC), require the installation of smoke alarms in all existing buildings constructed prior to November 6, 1974. All building codes adopted after that date also require the installation of smoke alarms.
Note: These alarms may be battery powered. They are not required to be hard wired and interconnected.
Public Act 376 of 2008 contains requirements for CO devices to be installed in housing constructed (permitted) on or after December 1, 2009 where residents are transient in nature. This includes hotels, motels and boarding houses.
Public Act 377 of 2008 allows the Director (DELEG) to require CO devices be installed in one and two-family dwellings and townhouses constructed (permitted) on or after March 23, 2009. This requirement is expected to be implemented in early 2011 with the adoption of Section R315 of the 2009 MRC. |

NAHB LEADERSHIP SEEKS INPUT ON BUILDER FINANCING CHALLENGES |

To help ease the severe acquisition, development and construction (AD&C) credit crisis that is threatening the solvency of countless home builders across the nation, NAHB is seeking credible case studies from a broad geographic cross-section of our members.
Here is how you can help. If you have experienced financing difficulties and are willing to share your story with NAHB, please consider telling your story. Individual builder profiles are essential to help NAHB make a strong case to regulators and the media about the severe financing problems builders are experiencing and the need to quickly resolve this crisis before more businesses are forced to shutter their doors.
Examples include builders who have been unable to obtain AD&C financing for viable projects, those who have experienced difficulties with an outstanding loan and even builders who have been forced out of business because of AD&C financing problems. Rest assured that NAHB will make every effort to maintain the confidentiality of the information provided and will obtain explicit permission from every builder prior to sharing any case study information they may provide.
Time is of the essence. We need to have the surveys completed by March 31. Our goal is to produce at least two credible studies from each state. We've also asked the National Area Chairmen and State Representatives to help in this effort. You may have already heard from them.
NAHB has developed an online template that will allow builders to readily share their financing experiences. To access it, you must first log on to www.nahb.org and then click on the AD&C Financing Box. The Web page can also be reached directly at www.nahb.org/adccasestudy. HBA RECEIVES INCREASING REQUESTS FOR REFERRALS |

Our association office is getting more and more calls each week from agencies, individuals, insurance agents and private individuals requesting lists of qualified builders who are specialists in universal design, aging in place, barrier free construction, green building or those who have EPA RRP certification. While we promise never to play favorites, and do point people to our online directory, sometimes more info is needed and provided. It was recently underscored again that professional designations are not only powerful marketing tools but viable assets to your business.
As an example, two separate agencies from the Detroit area recently contacted our office to acquire a list of HBA remodelers with CAPS certification who could assist in retrofitting a home for a closed-head injury patient in the Manistee area. A second agency caller needed an extensive remodel from a CAPS designee to accommodate a disability client in the Grand Traverse Area. Please know that your association is often your conduit to jobs you may be unaware of! |
