
Notice of Right to Organize Must Be Given to Employees of Federal Contractors
The Department of Labor has recently issued a final rule effective June 21, 2010 requiring that most federal contractors must post a notice to employees of their rights under the National Labor Relations Act. The required notice must be posted on 11 by 17 inch paper and is available online: http://www.dol.gov/olms/regs/compliance/EmployeeRightsPoster11x17_Final.pdf The notice must be prominently posted where it will be seen by significant numbers of employees, typically where other notices are placed. Such posting must also be made in a language other than English if a significant portion of the workforce is not proficient in English. In such case the posting must be made in the language in which that significant portion of employees are fluent. If the employer typically posts notices on an intranet site or online, the notice must be posted on such site as well. This obligation may be met by posting a link to the DOL page above (i.e. a link to the notice). Federal contractors with less than $100,000 in Federal contracts are exempt from the notice requirement as are subcontractors with less than $10,000 in Federal contracts. Failure to post the required notice can result in significant penalties including debarment. Violations may also result in violations of the NLRA.
