REPOSITIONING OLDER ASSETS
On Thursday, March 24, DCBIA presented "Repositioning Older Assets - Strategies That Add Value," a morning seminar held at National Press Club. Panelists included Rod Garrett of SOM/DC, Gregory Knoop of Somerset Partners, Mitchell Roschelle of PwC, Sean McDermott of Jones Lang LaSalle, Kinley Bray of Arent Fox - aptly moderated by Ellen McCarthy, Arent Fox.
Topics included trends in the DC office market; the flexibility that comes with the purchase of older assets (buyer has the option to leave the property as is, rehab or tear down and replace); the advantages of rehabbing and repositioning such properties (proven location, lower capital outlay, existing income/cash flow from current tenants), and renovation design. The panel also discussed the impact of zoning on building renovation. 1801 K Street served as the primary case model. Thanks and appreciation to an outstanding panel!

NEW LEGISLATION RAISES CONCERNS
Three bills have recently been introduced by Councilmember Phil Mendelson that at first glance appear to be counter-productive regulatory over reach.
Bill 19-169, the "Workplace Fraud Amendment Act of 2011," applies only to the "construction services industry" and directs the Mayor to investigate allegations by "interested parties" that employers are improperly classifying individuals as independent contractors instead of as true employees. The bill provides penalties (including treble damages) for employers who are found to be in violation. Since the status of independent contractors is already closely regulated by the IRS as part of the national tax code, the bill raises questions as to its real purpose, which may have more to do with the promotion of First Source and collective bargaining than with fighting fraud.
Bill 19-170, the "Large Retailer Community Agreement Act of 2011," requires large retailers (75,000 sf) to enter into a Community Benefits Agreement with "a broad-based coalition of individuals and entities that are reflective of the community in which the retail store is located," as a condition of a business license.
Bill 19-171, the "Large Retail Accountability Act of 2011," requires large retailers and its contractors to observe District First Source and Living Wage Acts - since they otherwise "threaten to erode living standards for working families in the District." A collective bargaining agreement, however, waives the requirements of the bill. In both cases, clearly discriminatory requirements are imposed on large retailers which can only retard retail development in the District.

DCBIA COMMUNITY SERVICES COMMITTEE PICKS 2011 CID SITE
The DCBIA Community Services Committee has selected the Marvin Gaye Recreation Center, located in Ward 7, as the site for the 19th Annual Community Improvement Day (CID) on Saturday, October 1, 2011. CID Co-Chairs Heather Daley, Cunningham | Quill Architects, and Steve Hawryluk, James G. Davis Construction Corporation, oversaw the first designer site walk-through and design charrette last Saturday, March 19. Representatives of the local community, ANC 7C, and Department of Parks and Recreation provided input and suggestions to the DCBIA design team comprising representatives from Clark Construction Group, Cunningham | Quill Architects, HOK, Interior Architects, James G. Davis Construction Corporation, Merrifield Garden Center, Norton Land Design LLC, Perkins+Will, Perkowitz + Ruth Architects, and RTKL Associates, Inc.
