Pool and spa energy changes and code proposals 
 
The FSPA Web site has information and documents about pool and spa energy changes and all the 2010 Florida Building Code proposals that will be heard in August.  These topics will be discussed at the Energy Committee and Builders/Service Councils meetings June 18 in Sarasota.  Click here for meeting information.
 

The Florida Building Commission's technical advisory committees will consider the code change propsals at the date, time and location as listed below:

Tax incentives available for hiring the unemployed

 On March 18, 2010 President Obama signed into law the Hiring Incentives to Restore Employment (HIRE) Act of 2010.  This Act provides two new tax incentives for employers who hire and retain unemployed workers:
 
Employers who hire unemployed workers this year (after 2/3/10 and before 1/1/11) may qualify for a 6.2% payroll tax incentive, in effect exempting them from their share of Social Security taxes on wages paid to these workers after March 18, 2010.

  • This reduced tax withholding will have no effect on the employee's future Social Security benefits, and employers would still need to withhold the employee's 6.2-percent share of Social Security taxes, as well as income taxes
  • The employer and employee's shares of Medicare taxes still apply to these wages.
 
It is important to understand that for this incentive to apply, the newly hired employee must have been out of work for 60 days prior to being hired with an allowance for a total of 40 hours work over that period.  The law requires that the employer get a statement from each eligible new hire certifying this fact and the IRS is currently developing a form that can be used to make the required statement.
 
The second tax incentive offered is that for each worker retained for at least a year, businesses may claim an additional general business tax credit, up to $1,000 per worker, when they file their 2011 income tax returns.
 
As these tax breaks are meant to raise the employment level, a new hire may not fill an existing position unless that employee left on their own or was fired with cause. Hiring a family member or any relative also doesn't qualify for this break.
 
This law is good news for those in the industry currently out of work and for employers seeing an uptick in business but who are still hesitant about hiring.  These incentives might have come just at the right time - for more information please consult your accountant or attorney.
 
 
CPSC launches national campaign on pool/spa safety 
Pool Safely campaign aims to reduce child drownings and entrapments  
 
The U.S. Consumer Product Safety Commission (CPSC) kicked-off the Pool Safely campaign (www.poolsafely.gov), a first-of-its-kind national public education effort to reduce child drownings and non-fatal submersions, and entrapments in swimming pools and spas. At a press conference at the Fort Lauderdale Aquatic Complex today, Olympic swimmers Jason Lezak and Janet Evans joined Inez Tenenbaum, Chairman of the CPSC; U.S. Rep. Debbie Wasserman Schultz (D-FL); and Nancy Baker, mother of Virginia Graeme Baker, to officially launch Pool Safely and release the CPSC's annual submersion and entrapment reports.

Governor Signs Legislation

Governor Crist was busy this week wielding his pen to sign several major pieces of legislation.  Of interest to FSPA are:
 
HB 713-Home Inspectors/DBPR Legislative package
HB 713 includes provisions for the regulation and licensing of home inspectors, mold assessor and mold remediatiors. 
 
SB 846-Residential Fire Sprinklers
SB 846 bans the Florida Building Commission from adopting the provisions of the International Residential Code that would mandate fire sprinklers in all one and two-family dwellings and prevents local governments from imposing sprinkler requirements on residential resort rentals.
 
HB 7179-Property Assessment Clean Energy ("PACE")
The PACE bill authorizes local governments to finance energy efficiency, renewable energy or wind-resistance property improvements with non-ad valorem tax assessments and create energy improvement districts funded by non-ad valorem tax assessments or bonds.
 
HB 7243-Recycling/Construction & Demolition Debris
HB 7243 creates the RecyclingBusinessAssistanceCenter to coordinate between state agencies and the private sector to facilitate new markets for recyclables.  Businesses are encouraged to report their recycling rates and counties must implement programs for recycling of construction and demolition (C & D) debris, reporting of processed C & D, and if economically feasible, all C & D is to be processed prior to disposal.  The Florida Building Commission is also directed to encourage recycling, composting and the use of recyclable materials.
