Statutory Strict Liability rule:

 

This law is practiced in 32 states and the District of Columbia in the United States. It states that the owner of the dog is responsible for the dog. Hence, damage caused by the dog is also his responsibility.

Although, the following states abide by the Statutory Strict Liability rule, its conditions vary in each state.

Florida man dies after dog attack
Attack dogs

Putnam County, FL man was severely attacked by two 'pit bull type" dogs while he was out gardening and sustained major injuries.

74 year old Roy McSweeney was taken off of life support and is now officially dead.

The story sadly follows a history of incidents involving these dogs.  18 months ago the dogs attacked another man on McSweeny's property and just last month, a 23 year old man suffered significant bites to both arms while visiting the dog's owner.  However, in spite of knowing abou the two different attacks, the city failed to act on these aggressive dogs and allowed them to remain in their home with no restrictions.  The dog's owner also apparently did nothing to prevent any other such incident.

Maybe more telling is that Capt. Johnny Greenwood apparently tried to blame the 1st victim for not seeking action after the first attack -- although the media notes that it is the city policy and state law that it is law enforcement's responsibility to take action, not the victim's. At this point, the Sheriff's office has quit talking to the media and is not issuing any more statements on the matter. 

The most frustrating part of this situation is that it was completely and 100% avoidable if the city had a dangerous dog law (that was enforced) that would target dogs that, based on their behavior, were known to be aggressive. Clearly these dogs would have qualified. And yet, in this case, dogs with a history of aggression were allowed to continue living in a home with no restrictions and with no punishment to the owner. 

Major attacks like this are never the dog's first act of aggression.

It's a sad and frustrating story and mythoughts and prayers go out to the McSweeney family.  While one media outlet has decided to try to make the story about the type of dog involved, it completely missed the key story here that any type of law doesn't matter if local officials will not take action when a dog has a bite history. You can't judge the actions of dogs without judging the people's actions around them.

Breed of the Month: 

Amerian Bulldog   

The American bulldog is a stocky, well built, strong-looking dog with very powerful jaws, a very large head, and a very muscular build.  

History:

The original bulldog was preserved by working class immigrants who brought their working dogs with them to the American South. Small farmers and ranchers used this all-around American Bulldogworking dog for many tasks including farm guardians, sto ck dogs and catch dog. These dogs were not an actual breed as considered by today's standards but were a generic bulldog type. There were no recorded pedigrees or records and breeding decisions were dependent on the best working farm dogs despite breed or background. Several separate strains of the "bulldog" type dogs were kept by ranchers as utilitarian working dogs.

By the end of World War II, however, these bulldog type strains were becoming extinct. Mr. John D. Johnson, a returning war veteran, decided to resurrect this breed. He found many  of the best specimens of these working type dogs and started recording pedigrees and family trees. His aim was to produce a large farm guardian-type bulldog, reminiscent of the bulldogs of old.  

Originally the breed was called the American Pit Bulldog and in the 1970s registered with the National Kennel Club (NKC) as such. Later the name was changed to American Bulldog to avoid confusion with the American Pit Bull Terrier.  

Color:  Combinations of solid or degrees of white; all shades of brindle, brown, red, or tan

Weight:  Male 70-140 lbs - Bully type can greatly exceed this weight.

Peter, a Chinese American who works for the post office in Rosemead, California, said he has been attacked by dogs twice in the past 10 years while delivering mails.

He said as a mail carrier, he has to walk door to door to put mails into the mailboxes of the residents, and many times the owners were not at home but their dogs were too loyal to their duties and would see mail carriers like him as intruders.

"It is dangerous to be a mail carrier. The enemy is not humans but animals like dogs who have been generally seen as human's best friends," Peter, who asked not to identify his full name, told Xinhua.

Mail carriers in the United States feel the real danger of being attacked by dogs while delivering mails door by door.

Statistics released by the U.S. Post Office showed that 5,669 postal employees were attacked by dogs in 2010 in the United States. That's an average of 11 dog attacks every delivery day, and that figure does not include the number of threatening incidents that did not result in injury.

Los Angeles is the third most dangerous city in the U.S. when it comes to being a mail carrier with 44 mail carriers being attacked by dogs in 2010, according to the U.S. Post Office.

San Diego in California and Columbus in Ohio tied for second place, each logging 45 dog attacks. Houston in Texas is the most dangerous city in the U.S. for mail carriers with 62 attacks in 2010.

On May 25, 2010, Eddie Lin, a 33-year old Chinese American postal carrier in San Diego, was attacked by a dog while delivering mail, his head hit on the ground and died 10 days later. His death angered his family and the whole community.

Man mauled, dies in violent dog attack Beware Pic

HENRIETTA TOWNSHIP,

 

Ohio - A man was mauled to death in a violent attack by his own dogs in his own driveway in Lorain County Tuesday afternoon.

The incident happened on State Route 511 in Henrietta Township.

Lorain County Sheriff's deputies said an assortment of eight to 10 dogs were kept in a fenced-in yard that extended from the back to the front of the home. The 30-year-old victim, Michael Winters, and his father, Michael Kywa, both lived there.

Investigators said around 11:30 a.m. on Tuesday, the father left the house and then returned at about 12:15 p.m. At some point during that period, his son came home and was attacked by the dogs in the driveway.

Kywa called 911. When emergency crews arrived, they pronounced Winters dead at the scene.

The coroner said Winters had been bitten many times and it appears several dogs were possibly involved in the attack.

Deputies rounded up the dogs and put them down, per the father's request. But some are still believed to be loose.

Mitzi Robinson's comments on SprayShield; the main reason sprays work on some dogs is because of the spray action. The dog is scared off by the spray before the smell. The smell is secondary. This and stronger sprays like Wasp or Bee sprays can cause extensive injuries to a child when the child graps hold of their pet after being sprayed. This will not happen with SprayShield.
