Human Trafficking 101: Understanding Human Trafficking, Learning How to Identify Possible Victims, and Options for Immigration Relief (2.0 MCLE) Thursday, March 5, 11:00 am - 1:00 pm PST Presenters: Ivy Lee, API Legal Outreach, and Lynette M. Parker, Santa Clara University School of Law Fee: $130 Regular / $80 Non-profit / $20 CA IOLTA Deadline to register: 3/3/09 This webinar will introduce you to the dynamics of human trafficking in the United States. We will use real case examples to cover the elements of trafficking in persons, illustrate common red flags of a trafficking situation for adults and/or children, and detail the requirements for T visa relief. Many victims of human trafficking do not perceive themselves to have been trafficked, and many forms of trafficking do not fit the public perception of trafficking. Understanding the nature of human trafficking will enable you to more effectively identify clients who may have been trafficked into, or while being present in, the United States and thereby qualify for trafficking-related immigration and other relief. We will review various elements of human trafficking, noting common red flags and special circumstances particular to both adult and child victims. We will also cover the basic requirements for T visas, including discussion of definitions of terms such as "severe form of trafficking," "debt bondage," "peonage," "force, fraud, or coercion," as well as a discussion of "continued presence" and the process of "certification" for trafficked persons. CSPA Made Simple (1.5 MCLE) Wednesday, March 11, 10:00 am - 11:30 am PDT Presenter: Charles Wheeler, CLINIC Fee: $110 Regular / $70 Non-profit / $15 CA IOLTA Deadline to register: 3/9/09 We will provide step-by-step instructions on understanding and applying the Child Status Protection Act (CSPA). This webinar will cover how the law applies to immediate relatives, unmarried children of lawful permanent residents, derivative beneficiaries in the family and employment categories, VAWA grantees, and asylee/refugee derivatives. We will also cover any recent court challenges or USCIS policy memos. Through the use of examples and hypothetical exercises, participants will be able to apply CSPA principals to typical fact scenarios. Advanced Trafficking in Persons and T Visas (2.0 MCLE) Wednesday, March 18, 11:00 am - 1:00 pm PDT Presenters: Ivy Lee, API Legal Outreach, and Lynette M. Parker, Santa Clara University School of Law Fee: $130 Regular / $80 Non-profit / $20 CA IOLTA Deadline to register: 3/16/09 For advocates and attorneys familiar with trafficking in persons and T visas, this webinar will focus on the unique and complex issues that frequently arise in human trafficking cases. We will discuss how to develop and work with a multidisciplinary team that typically includes law enforcement, social service providers, case managers, and multiple attorneys in both civil and criminal arenas; how to effectively address grounds of inadmissibility; the process of certification for adult and child trafficking victims; strategies to avoid conflicts of interest and best practices to preserve and protect confidentiality in a trafficking case; and special needs of trafficked persons that advocates and practitioners must be aware of in order to effectively serve this unique population. The webinar will draw from the experience of practitioners whose practice focuses on representation of trafficking victims and who have more than 12 years of anti-human trafficking experience providing comprehensive legal and non-legal services to survivors of human trafficking. T Visa Applications and Procedures (2.0 MCLE) Tuesday, March 24, 11:00 am - 1:00 pm PDT Presenters: Ivy Lee, API Legal Outreach, and Lynette M. We will discuss strategies to prove the elements, techniques for preparing a successful application, the procedures for filing a T visa, time-lines for adjudication of a T visa application, and finally, the newly-issued adjustment of status regulations for T visa holders. We will provide nuts-and-bolts information for practitioners who want to add the T visa and T visa-based adjustment of status applications to their current roster of immigration options for current and future clients. Topics will include grounds such as visa fraud, false claims to citizenship, alien smuggling, public charge, the three- and ten-year and permanent bars, past removals, and an introduction to criminal issues. Mehr Fee: $110 Regular / $70 Non-profit / $15 CA IOLTA Deadline to register: 5/14/09 The "categorical analysis," which includes the rules governing divisible statutes and the record of conviction, is perhaps the most important defense tool for noncitizens with criminal records. Practitioners representing such immigrants must have a thorough understanding of this area to adequately defend clients. In the past few years, the Ninth Circuit has published key decisions that greatly expanded the benefits that the categorical analysis provides to immigrants. At the same time, the Attorney General, Board of Immigration Appeals, and a few Ninth Circuit panels, have published decisions that would limit these benefits, and the Supreme Court has accepted certiorari in a case involving one aspect of the analysis, in Nijhawan v. Attorney General (January 16, 2009). This webinar will discuss the current state of the law, and provide an organized analysis of best practice defense strategies. While providing an overview of the categorical analysis for those new to the area, it will focus on defense arguments, possible government arguments, and how to deal with pending litigation, such as Nijhawan and the Attorney General decision in Matter of Silva-Trevino. ----------------------------------------Seminars---------------------------------------
Thursdays & Fridays, March 12, 13, 19, 20, 1:00 pm - 5:30 pm Location: Asian Pacific American Legal Center, 1145 Wilshire Blvd., 2nd Floor, Los Angeles, CA 90017 Presenter: Don Ungar, Simmons & Ungar and ILRC Fee: $495 Regular / $240 Non-profit / $80 CA IOLTA Deadline to register: 3/2/09 Designed for a lawyer who wants to boost his or her knowledge and confidence, this course covers the fundamental concepts and elements of immigration law and procedures. The program will cover all major themes of immigration law, including constitutional issues, grounds of inadmissibility and deportability and related procedures, waivers and relief from removal, the various immigration preference categories, nonimmigrant classes, refugees and asylum, adjustment of status, administrative appeals and judicial review, and the acquisition of American citizenship. NOTE: This seminar is limited to attorneys and BIA Level 2 Accredited Representatives. Limited to 20 registrants. Cancellation of Removal for Nonpermanent Residents & How to Analyze "Exceptional and Extremely Unusual Hardship" (2.75 MCLE) Thursday, March 19, 2:00 pm - 5:00 pm Location: The Bar Association of San Francisco, 301 Battery St., 3rd Floor, San Francisco, CA 94111 Presenters: Angie Junck and Nora Privitera, ILRC Fee: $165 Regular / $90 Non-profit / $35 CA IOLTA Deadline to register: 3/10/09 Free to those who commit to BASF's VIP Program. Contact Antonio Hernandez at 415-782-9000 x8113 before registering. Cancellation of removal is currently the only potential remedy for the majority of undocumented immigrants in removal proceedings. Though the standard of proof for this remedy is difficult to meet, this seminar will teach you how to prepare the best cancellation of removal case possible for each of your clients. This seminar will both analyze all the elements necessary to prove a case for cancellation of removal and provide practical pointers for preparing your case. Topics covered include: Physical presence and the stop time rule Good moral character, how it is defined and when the statutory period for establishing good moral character ends Specific criminal bars and how to argue that they don't apply Defining "exceptional and extremely unusual hardship," including an in-depth analysis of the leading cases on this issue Identifying the different factors that have been recognized by the BIA and the federal courts as relevant to establishing exceptional and extremely unusual hardship How to best work with clients to elicit important information that is relevant to establishing their hardship claims As Cancellation of Removal topics are oftentimes difficult to digest, this unique seminar will provide succinct explanations, with an emphasis on how to elicit relevant information from clients. In addition, you will learn easy steps on how to prepare clients to testify and to analyze relevant hardship cases to support a hardship claim for any immigration remedy that requires some showing of hardship. How to Defend Permanent Residents from Removal (2.75 MCLE) Friday, April 10, 1:00 pm - 4:00 pm Location: UCLA School of Law, 405 Hilgard Ave., Los Angeles, CA 90095 Presenters: Angie Junck and Nora Privitera, ILRC Fee: $165 Regular / $90 Non-profit / $35 CA IOLTA Deadline to register: 3/30/09 This seminar is designed to teach practitioners how to effectively defend permanent residents charged with being removable.
